The purchase of any travel services offered by Tour Architex and Associates,  Inc. (also referred to in these terms & conditions as “Tour Architex and Associates,  Inc.¨ or “TAA”), constitutes a contractual arrangement between you (also referred to in these terms & conditions as “traveller”) and TAA, and represents your acceptance of TAA’s Terms & Conditions as set out herein. Please ensure that you have carefully read and understood the Terms & Conditions prior to booking. You represent and warrant that you are authorized to accept TAA’s Terms & Conditions on behalf of everyone named in your booking, and you will be deemed to have accepted TAA’s Terms & Conditions on behalf of everyone named in your booking. You are advised to check TAA’s websites for the latest version of the Terms & Conditions prior to booking your trip.

DEPOSITS & PAYMENTS: TAA accepts payment via most major credit cards. A non-refundable deposit of $500 per person, per trip, is required for TAA to reserve your space unless otherwise stated. All payment plans require monthly automated payments to be debited from your credit/debit card. You can contact our office at any time to make an additional payment or pay in full.

Please review and verify your booking invoice thoroughly and contact TAA immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. TAA cannot accept responsibility if it is not notified of invoice inaccuracies or missing add-ons. In the case of billing errors, TAA reserves the right to re-invoice you with correct pricing.

Once you miss two monthly payments your trip is subject to cancellation.  Once your trip is cancelled you will be notified via your email. You may reinstate your trip within 7 calendar days of cancellation by paying the full amount past due.

REFUND & CANCELLATION POLICY:

If you have any issues where you cannot attend, you will have to appeal to the travel insurance company with whom you purchased your travel insurance. We highly recommend you purchase a comprehensive travel insurance policy within 3 days of sending your first deposit. Your insurance should include trip cancellation that includes a ¨cancel for any reason¨ option to cover your non-refundable expenses should you cancel your trip for any reason, whether voluntarily or as a result of TAA actions.  We also advise travellers to inquire with the insurance provider, whether or not the insurance covers Covid-related incidents including Covid tests, flight rebooking or rerouting, additional lodging expenses, etc., that may arise while travelling. Please be aware that your reasons for cancellation must fall within the guidelines of trip interruption/cancellation in order to be covered.

We certainly understand that life happens and travel plans may change. Though your deposit is non-refundable, depending on the situation, the company can extend your deposit to a future group trip or a customized trip.

​TRAVEL DOCUMENTS: Travel Documents, including e-ticket itineraries, are sent via email approximately four weeks prior to departure provided full payment, completion of medical disclosure and emergency contact details have been received.

ITINERARY CHANGES:  While we make every effort to execute the itineraries provided on the website, itineraries are subject to modification and change due to availability or vendor partner changes.  In the unlikely event that there are major changes to the itinerary, clients are notified as soon as possible and an equivalent substitution will be offered.

HEALTH & WELLNESS POLICY: A majority of the trips well require you do at least two to three miles of walking per day, and some may involve strenuous activities. If you are not sure whether or not you can participate on any tour, please contact one of the tour directors for a conversation to see if you are suitable to participate. We also ask that each traveller consults their doctor to ensure they are healthy and have no issues travelling and participating in the tour of the travellers choice.

PHOTO/VIDEO RELEASE:  Photos and videos are taken daily throughout TAA trips. In attending a TAA you are giving TAA the right to use the videos and photos in promoting future trips.

VISA AND OTHER TRAVEL REQUIREMENT DOCUMENTS:  Travel visas and other travel required documents (Covid-related tests, etc.) requested by the destination country need to be in good standing. It is the responsibility of each traveller to comply with them and to secure the proper travel documents. To avoid disappointment and unnecessary expenses, please carefully review the requirements so that you can obtain all necessary documents well before your trip. Requirements are subject to change, often without notice, and we suggest you verify requirements with the relevant embassy or consulate. TAA will not be held responsible for any charges, trip interruptions, or cancellations due to incorrect or missing visas.

DAMAGES:  We accept no responsibility for accidents, damage, baggage losses, delays and/or accidental expenses due to weather, strikes, acts of God, acts of governments or authorities, wars, terrorism, criminal acts committed by third parties, hostilities, civil disturbances, riots, strikes, sickness, pandemics, quarantine, defects of vehicles or breakdown in equipment, or to the fault or default of any company used for carrying out these packages. Regarding any and all services and accommodations furnished, we expressly disclaim all responsibility or liability over any matter whatsoever for loss, damage, injury or expense to property or person due to any cause whatsoever occurring during the duration of the trip or otherwise. All such losses or expenses will be borne by the passengers

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Tour Architex and Associates, Inc. content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Tour Architex and Associates, Inc. and the copyright owner.  You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Tour Architex and Associates, Inc. or our licensors except as expressly authorized by these Terms.

Arbitration

In the event, the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgement may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to the Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN.  Tour Architex and Associates, Inc. AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
